In 1973, the Michigan Legislature Enacted
the No-Fault Insurance Act. Under this law
an individual’s insurance company is
primarily responsible for paying for his or
her vehicle damage, medical and hospital
costs, rehabilitative expenses, wage loss,
property damage, home health care costs,
and other costs in the event of an accident.  
These benefits are called Personal Injury
Protection benefits (also known as PIP
benefits).  An injured driver, injured
passenger, or deceased victim’s family may
sue the at-fault driver for the accident only if
the accident causes death, permanent serious
disfigurement, or serious impairment of a
body function.  If this “threshold of injury”
or death occurs, then the at-fault-driver’s
insurance company may be responsible for
paying wrongful death benefits, pain and
suffering compensation, and/ or economic
damages that exceed PIP benefit maximums.
